Depends on the location. Here in Texas, the legal climate is favorable to physicians. Texas is a state now known for tort reform. As part of this tort reform, several limits have been placed on the damages those injured by medical malpractice can receive. Most notably, with a law that took effect in 2003, damages for pain and suffering are now limited to $250,000 in most malpractice cases.

Not necessarily. what is true is that they have the highest malpractice insurance because of the nature of their job.

As all physician groups, most anesthesiologists will face a lawsuit during their career, they are not the most sued. According to recent studies, obstetricians/gynecologists (ob/gyns) and surgeons are most likely to be sued.
